1. Agreement
1.1 These Charge Anytime terms and conditions (the Terms) form the agreement between you and us:
(a) “You” are the person who has signed up to Charge Anytime; and
(b) “OVO”, “we”, “us” or “our” is OVO Energy Limited. Our address is 1 Rivergate, Temple Quay, Bristol, United Kingdom, BS1 6ED.
1.2 These Terms are specific to the Charge Anytime add-on. They are separate to:
1.2.1 the OVO Core Terms and Conditions (“Core Terms”: ovoenergy.com/terms);
1.2.2 the OVO charge mobile application terms (the “OVO Charge App Terms”: https://www.ovoenergy.com/terms/charge-anywhere);
1.2.3 the Charge Anywhere terms (the “Charge Anywhere Terms”: https://www.ovoenergy.com/terms/charge-anywhere); and
1.2.4 any specific terms which may apply to any energy tariff you are on with OVO.
1.3 Your use of Charge Anytime is also subject to our privacy policy which can be seen at https://www.ovoenergy.com/privacy-policy.
1.4 Definitions - Certain terms have a particular meaning when they are used in this document. We have listed those terms in clause 17, and they are highlighted in bold when they are used.
2. Charge Anytime
What is Charge Anytime?
2.1 Charge Anytime is an add-on product to OVO’s eligible electricity tariffs. It applies to home EV charging for customers with a Compatible EV or Compatible Charger. With Charge Anytime, OVO optimises your EV charging times to charge at the cheapest time in the wholesale market and at the greenest times of the day (being when the carbon intensity of the electricity required to charge your EV is at its lowest). You then pay a lower rate when Smart Charging your EV whilst the rest of your home energy use is charged at your electricity tariff’s usual rate.
2.2 Provided you meet (and continue to meet) the Eligibility Criteria (see clause 5), you can sign up to Charge Anytime as follows:
2.2.1 If you have a Compatible EV or Compatible Charger you can sign up to Charge Anytime by:
2.2.1.1 downloading the OVO Charge app (and agreeing to the separate app terms); or
2.2.1.2 selecting the Charge Anytime add-on in your OVO energy account (either the app or web), registering your details and creating an account in the OVO Charge app and completing the sign up journey.
2.3.2 If you have a fully electric Volvo, you can sign up for Charge Anytime via your OVO account (app or web) by completing the sign-up journey, or by downloading the Volvo Cars app, connecting your vehicle within the Volvo Cars app and following the instructions in the Charge Anytime banner.
3. How it works
3.1 Charge Anytime works as follows:
3.2.1 By signing up to Charge Anytime, you are agreeing to OVO remotely managing and scheduling the charging of your EV.
3.2.2 Your home energy rate will stay the same, but the electricity consumed by your EV when Smart Charging at home will be charged at the then current Charge Anytime Rate. Rather than being charged at a lower rate for your Smart Charging, you’ll receive a credit to your bill (Charge Anytime Credit) – see clause 4.
3.2.3 You can override Smart Charging mode at any time and use your Charger in Urgent Charging mode, however, you will not be entitled to the Charge Anytime Credit and will be charged your regular electricity tariff rate.
3.3.4 Based on your charging preference we may adjust the Smart Charging schedule of your EV. We will aim to charge your EV to your charging preferences by the end of the Smart Charging period that you have selected in the OVO Charge app. Disconnecting your EV before the ready by time may result in the EV not reaching your charging preferences.
3.3.5 You’ll also be able to see insights about your EV charging and the savings you’re making with the Charge Anytime add-on in the “Activity” tab of the OVO Charge app.
4. Charge Anytime Credit
4.1 All electricity you use will initially be charged at the normal unit rate you pay for your OVO energy tariff – and these rates will be reflected on your bill, along with your normal standing charges.
4.2 In the first working week of each month, you’ll receive a credit based on how much of your total electricity use in the previous month went into Smart Charging your EV. This will be your Charge Anytime Credit.
4.3 The Charge Anytime Credit provided will effectively mean that each month your total balance will be equal to what you would have owed if your Smart Charging consumption had been charged at the Charge Anytime Rate.
4.4 All other energy use will be as per the rates on your standard OVO energy tariff, namely:
4.4.1 all home energy use will be charged at your standard OVO energy tariff rates for electricity and gas;
4.4.2 standing charges (or "fixed charges") associated with your tariff will remain the same and no credit will apply; and
4.4.3 Urgent Charging will be charged at your standard OVO energy tariff electricity rate.
4.5 The amount of Charge Anytime Credit you’ll receive each month will vary depending on how much you charge your EV that month, how much you Smart Charge, and how much you Urgent Charge. For an example of how your Charge Anytime Credit will be calculated, please see our FAQs.
4.6 Only electricity that has been used from the grid for Smart Charging will be considered in the Charge Anytime Credit calculation. For customers who have a solar PV installed in their home, OVO can only currently offer Charge Anytime Credit where the customer has a Solar Compatible Charger (displayed as ‘solar-compatible’ on this list). Your Charger may also require a CT clamp installation. All other local solar or non-grid electricity that goes into EV charging will be excluded from the Charge Anytime Credit calculation.
4.7 Your direct debit won’t be affected by the Charge Anytime Credit applied to your account with the Charge Anytime add-on. If you have any Charge Anytime Credit left when you leave OVO, this will be offset against your final bill.
4.8 The Charge Anytime Credit cannot be converted to cash or an alternative cash equivalent.
5 Charge Anytime Eligibility
5.1 To be eligible for Charge Anytime, you’ll need to meet (and continue to meet) the following criteria (Eligibility Criteria):
5.1.1 You’re an existing OVO energy pay monthly customer and pay by direct debit – you can be on any compatible OVO tariff (and either supplied with both fuels or electricity only);
5.1.2 You have a Compatible EV or Charger with a working internet connection. It is your responsibility to ensure your Charger has the most up to date firmware installed, otherwise your Charger may not be compatible;
5.1.3 You configure your EV and/or Charger as instructed by us during onboarding to Charge Anytime;
5.1.4 You have a smart meter that communicates half-hourly data to OVO – currently the main types of smart meters that work with Charge Anytime are SMETS2 meters by any manufacturer, and SMETS1 meters manufactured by Secure;
5.1.5 You opt in to sharing half-hourly smart meter data with OVO. If you aren’t currently opted in to sharing half-hourly data you agree that we can automatically update your preferences if you select the Charge Anytime add-on;
5.1.6 You comply and continue to comply with these Terms, the OVO Charge App Terms, the Core Terms and any other OVO terms which apply to you;
5.1.7 You must comply with any tariff eligibility requirements that you accepted when joining your tariff;
5.1.8 The data you provide must be accurate (see clause 7 for details);
5.1.9 You must not have signed up to any other non-OVO schemes that enter your home or EV into Flexibility Services or try to control your EV charging while you’re using Smart Charging; and
5.1.10 Charge Anytime depends on you allowing us to optimise charging. Frequent Urgent Charging may lead to us removing you from Charge Anytime.
5.2 If we have accepted you onto Charge Anytime but later discover that your electricity tariff, your EV, your Charger, your property or any other requirements are not suitable, or you are not Smart Charging in the manner we would expect for a typical domestic EV user, we may remove your access to Charge Anytime. We will let you know in advance if this is the case.
5.3 We reserve the right at any time to amend any eligibility criteria or product usage conditions at our discretion.
6. Flexibility Services
6.1 In order to be able to charge your EV in accordance with the needs of the grid and enable lower cost charging, we'll sometimes participate in Flexibility Services and grid balancing events with Market Operators and Network Operators. This includes sharing charging pattern data from your EV with them as well as your Meter Point Administration Number (MPAN). Flexibility Services include, but are not limited to, the Demand Flexibility Service and other Balancing Services, Constraint Management Services, the Balancing Mechanism, Capacity Markets and other flexibility market trials or pilots. During Flexibility Services, we’ll still control your Smart Charging to deliver the required quantity of energy within the ready-by-time set by you.
6.2 By signing up to Charge Anytime and agreeing to these Terms you:
6.2.1 authorise us to enter Flexibility Service contracts with your EV and share relevant data with the relevant Market and Network Operators, including but not limited to your half-hourly consumption data, home address and Meter Point Administration Number (MPAN) where necessary;
6.2.2 give us the exclusive right to control your EV for the purposes of providing Flexibility Service contracts (including but not limited to the Demand Flexibility Service, Constraint Management Services and Balancing Mechanism & Capacity Markets) as and when required by such contracts while you remain on Charge Anytime;
6.2.3 agree not to enter your household, your EV or any other low carbon technology you own into a third party’s scheme that enters you into a Flexibility Service (including but not limited to the Demand Flexibility Service, Distribution Constraint Management Services and Balancing Mechanism & Capacity Markets) while you remain on Charge Anytime. If we reasonably believe you have joined another third party’s scheme, we have the right to remove you from Charge Anytime.
6.3 By authorising us to provide Flexibility Services for your EV, charging and subsequent optimisation may result in shorter or more frequent charging cycles. While this service aligns with industry practices for such services, frequent charging may affect the lifespan of your EV's battery.
6.4 We do not guarantee that Charge Anytime will be compatible with your EV battery or that it will operate in accordance with your preferences. We accept no liability for wear of your battery, scheduling failure or other electric faults.
7. Data sharing – what data we collect and how we use it
7.1 Charge Anytime is powered by the Kaluza Flex Platform. Kaluza will gather data from your EV or Charger via the Kaluza Flex Platform, and report your EV charging consumption data to OVO so that we can credit your account correctly. Kaluza will also use the Kaluza Flex Platform to optimise your EV charging times based on grid demand and the distribution network.
7.2 By signing up to Charge Anytime you agree to:
7.2.2 allow OVO and its partner Kaluza to connect to your EV or Charger or both of them, and collect relevant data in order to provide Charge Anytime to you, such as charging schedule, consumption information, EV/Charger make and model, efficiency and battery capacity;
7.2.4 be opted into half-hourly data sharing from your smart meter. Your continued participation in Charge Anytime will be taken as an indication of your consent for us to set your meter reads to half hourly and consent to our collection of this half hourly consumption data.

7.2 You can change your data sharing preferences at any time but if you do so you’ll no longer be able to benefit from Charge Anytime, as we’ll no longer have the data we need to be able to provide the Charge Anytime service to you.
8. Accuracy of data
8.1 Charge Anytime Credit will be added to your account based on the data that we receive from your Charger or EV. If you’re accessing Charge Anytime via your EV, this data will be modelled on data directly from your EV. If you’re connecting through your Charger, the data will come to us from the charger manufacturer. This may result in some variations in the accuracy of the data and as a result, the accuracy and amount of your Charge Anytime Credit may also vary.
8.2 OVO takes no responsibility for the accuracy of the data received from your Charger or EV and therefore the accuracy of the Charge Anytime Credit paid using that data.
8.3 We may carry out checks on charging data we receive from time to time, and if we deem that your device is sending inaccurate data and is therefore not eligible for Charge Anytime, OVO reserves the right to remove Charge Anytime from your account. Please consult with your Charger manufacturer or EV manufacturer if you’re concerned about the accuracy of data recorded.
8.4 You’re responsible for making all arrangements necessary to ensure your Charger or EV is connected to the internet and to your OVO energy account via the OVO Charge app. You’ll also be responsible for downloading any updates to the OVO Charge app as required.
8.5 If your Charger or EV goes offline at any point for any reason, or if you’re disconnected from the Kaluza Flex Platform for any reason, we won't record Smart Charging electricity consumption during this time. This means that you won’t receive Charge Anytime Credit during this period.
9. Changes to Charge Anytime
9.1 We reserve the right to make changes to Charge Anytime and/or these Terms at any time including without limitation amending the product, changing the Charge Anytime Credit or Charge Anytime Rate, amending the eligibility criteria, product usage conditions, and the Compatibility of EV and Chargers.
9.2 Where any changes we make put you at a disadvantage we’ll give you reasonable notice so that if you do not wish to continue using Charge Anytime, you can remove the Charge Anytime add-on by following the process outlined in clause 10.
10. If you want to cancel Charge Anytime
10.1 You’re free to remove Charge Anytime from your account at any time. You can remove it by going to the OVO energy app and clicking ‘Cancel my add-on’ in the ‘Manage add-ons’ section of your OVO energy account. Or via the OVO website if you're using a web browser, visit the ‘Plan’ section of your OVO energy account, and select ‘Cancel add-on’ within the Charge Anytime section. Please note this needs to be done in your OVO energy account, not in the Charge Anytime app.
10.2 When Charge Anytime is cancelled, we’ll no longer receive your EV charging consumption data. Any Charge Anytime Credit accrued to the point of cancellation will be paid to you in the first week of the following month.
10.3 Once you remove Charge Anytime, your EV charging data will no longer be shared with OVO, however, you’ll be able to continue to view your prior consumption data and insights in the OVO Charge app for up to 13 months once Charge Anytime is removed from your account. Note it may take up to 7 days to fully disconnect your EV or Charger from Charge Anytime, during which time data may still be collected from your EV and the charging of your EV may still be controlled.
10.4 Please note that if you delete or discontinue use of the OVO Charge app but do not delete your Charge Anytime add-on from your OVO energy account, we’ll retain the capability to control the charging of your EV. We’ll retain this capability unless and until you follow the procedure set out in 10.1 above.
10.5 You can add Charge Anytime to your account again starting from the next month after you’ve cancelled.
11. Fair Usage Policy
11.1 You agree to comply at all times with these Terms and agree that you’ll principally home charge your EV at the domestic address registered on your OVO energy account. The maximum monthly Charge Anytime Credit you can receive is £100 per month per account. Any Smart Charging consumption that exceeds the maximum Charge Anytime Credit will be charged at your tariff’s usual rate. For an example of what this Charge Anytime Credit equates to in monthly consumption please see our FAQs. The amount of monthly consumption this equates to may vary based on the current Charge Anytime Rate and your tariff’s usual rate.
12. Suspension and Termination
12.1 We may, at any time, suspend, limit or terminate your use of Charge Anytime (in whole or in part) temporarily or permanently. We may do this:
12.1.1 if we are making repairs, updates, or conducting maintenance on our systems;
12.1.2 if we have concerns about the security of the Charge Anytime services;
12.1.3 if we know or suspect that Charge Anytime services are being used fraudulently or in an unauthorised way or in violation of these Terms. This includes setting up your EV or Charger in a way which means that the Charge Anytime Rate applies to energy consumption which isn’t related to the Smart Charging, or excessive overuse or misuse of the Charge Anytime;
12.1.4 if there are legal obligations which we have to meet;
12.4.5 if we are prevented from providing the Charge Anytime services (or any part of them) for any reason beyond our reasonable control;
12.4.6 you fail to pay for services that have been provided to you, or you cannot pay your debt;
12.4.7 for any other reason at our absolute discretion (we endeavour to give you reasonable notice of our intention to do so but may not be able to do so in all circumstances).
12.2 If Charge Anytime ends for any reason, your residential energy supply will continue in accordance with its terms.
13. Liability
13.1 We shall not be liable:
13.1.1 any damages, liability or losses arising out of your use of or reliance on Charge Anytime or your inability to access or use Charge Anytime even if we have been advised of the possibility of such damages;
13.1.2 for delay or failure in performance resulting from causes beyond our reasonable control;
13.1.3 any lack of availability, interruption, modification, suspension or cessation of Charge Anytime;
13.1.4 failure or delay, incorrect functioning of or inaccurate the Charge Anytime data in the OVO Charge app;
13.1.5 any business losses. Charge Anytime is for domestic and private use;
13.1.6 your failure to comply with these Terms;
13.1.7 any failure to credit your account for reasons outside our reasonable control, including if we’re unable to gather adequate information from your EV or Charger, you do not leave your EV or Charger connected to the internet, we cannot obtain half-hourly data reads from your smart meter; and/or
13.1.8 for indirect, incidental, special, exemplary, punitive or consequential damages, including loss of profits, loss of income, non-realisation of expected savings, loss of an opportunity, damage as a result of loss or corruption of data, loss of goodwill and/or reputational damage, downtime costs and similar financial or economic losses, personal injury or property damage related to, in connection with, or otherwise resulting from any use of Charge Anytime.
13.2. Whilst we use reasonable skill and care in providing the Charge Anytime service to you, we cannot be held responsible for the acts and/or omissions of any third parties.
13.3 Participating in Charge Anytime, including Smart Charging, may affect your EV battery’s performance and lifespan. We do not guarantee that using Charge Anytime will avoid battery degradation and it may impact your EV battery’s lifespan or value. It is your responsibility to ensure that Charge Anytime is compatible with your battery’s warranty. We shall not be liable for any damages, liability or losses relating to your battery arising out of your use of Charge Anytime.
13.4 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.
13.5 In no event shall our total liability to you in connection with Charge Anytime for all damages, losses and causes of action exceed five hundred pounds sterling (£500).

15. Transfer of Rights
15.1 We may transfer, subcontract, assign or novate any or all of our rights (including the right to recover the charges) or obligations under these Terms without your consent, but this will not affect your rights under these Terms.
15.2 You may not transfer any of your rights under these Terms without first obtaining our written consent.
15.3 These Terms shall be binding on, and enure to the benefit of, the parties to this terms and their respective personal representatives, successors and permitted assigns, and references to any party shall include that party's personal representatives, successors and permitted assigns.
16. Miscellaneous and Governing Law
16.1 Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect. Even if we delay in enforcing these Terms against you, we can still enforce them later
16.2 These Terms are governed by the laws of England and Wales, and any disputes arising shall be dealt with exclusively by the English courts.
16.3 Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect. Even if we delay in enforcing these Terms against you, we can still enforce them later.
16.4 These Terms are governed by the laws of England and Wales, and any disputes arising shall be dealt with exclusively by the English courts.
17. Definitions
Certain terms have a particular meaning when they are used in this document as follows:
Balancing Mechanism: means the service procured by the National Electricity System Operator to manage supply and demand on the transmission network. For more detail, see Elexon’s definition here: elexon.co.uk/glossary/balancing-mechanism;
Balancing Services: means services procured by the National Electricity System Operator to balance demand and supply and to ensure the security and quality of electricity supply across Britain's transmission system;
Capacity Markets: means the service procured by the Government through yearly auctions to maintain sufficient generation capacity to meet peak national demand;
Charge Anytime: means the name given to the product offering provided which allows OVO energy customers to benefit from a low charging rate for EV consumption when Smart Charging;
Charge Anytime Credit: means the credit paid to your OVO energy account in the first week of each month, to adjust your bill such that your Smart Charging costs are effectively charged at the Charge Anytime Rate;
Charge Anytime Rate: means the effective kWh rate offered to Charge Anytime customers for Smart Charging. For details of our current rates please see ovoenergy.com/electric-cars/charge-anytime;
Charge Anywhere Terms: has the meaning given in clause 1.2;
Charger: a single charge point unit used to charge your EV at your home;
Compatible Charger and/or EV: means an EV or Charger which is compatible with Charge Anytime, as updated from time to time. Compatible systems are listed here [https://www.ovoenergy.com/electric-cars/charge-anytime-cars-and-chargers] and are determined at OVOs' sole discretion;
Core Terms: has the meaning given in clause 1.2;
Constraint Management Services: means services procured by Distribution System Operators to manage constraints on the distribution network or procured by the National Electricity System Operator to manage constraints on the transmission network;
Demand Flexibility Service: means the service procured by the Electricity System Operator to manage supply and demand on the transmission system;
Distribution System Operators: means the collective operators of Britain’s local electricity distribution network;
Electricity System Operator: means the operator of Britain’s electricity transmission system;
Eligibility Criteria: has the meaning given in clause 5;
EV: means electric vehicle;
EV App: means your vehicle manufacturer’s application, for example the Volvo Cars app;
Flexibility Services: refers to procured demand flexibility services and trials, including but not limited to, the Demand Flexibility Service, Constraint Management Services, the Balancing Mechanism, and Capacity Markets;
Kaluza: means a company registered in England and Wales with company number 12218299, whose registered office is at 140–142 Kensington Church Street, London, W8 4BN and whose VAT number is 100119879. More about Kaluza at kaluza.com;
Kaluza Flex Platform: means the Kaluza product offering known as ‘Kaluza Flex’ which manages distributed smart devices;
Market Operator: means a third-party who operates the market for Flexibility Services on behalf of the Network Operator;
Network Operator: means either the relevant Distribution System Operator or the Electricity System Operator;
OVO Charge app: means the OVO charge mobile application, available by OVO which we use to manage Smart Charging through your EV or Charger;
OVO Charge App Terms: has the meaning given in clause 1.2;
Smart Charging: means when we manage the charging of your EV remotely , i.e. without the you selecting Urgent Charging mode for a scheduled charging session. Smart charging would typically involve the EV being charged flexibly in accordance with the needs of the grid or local microgeneration.This may involve us adjusting the EV’s charging to a time when electricity demand on the grid is lower;
Solar Compatible Charger: means a Charger which is compatible with a solar PV set up and allows a user to charge their EV using their solar energy, as updated from time to time. Compatible systems are listed here [https://www.ovoenergy.com/electric-cars/charge-anytime-cars-and-chargers ] and are determined at OVOs' sole discretion;
Urgent Charging: means any charging that takes place in manual or urgent mode (also referred to as Override, Boost, Urgent Charge or Max Charge), i.e. the EV charger is forced to charge at full power. Urgent charging can also result from a lack of charging schedule in the app used to control when your vehicle will be ready by;
Unless the context otherwise requires, words in the singular shall include the plural and in the plural shall include the singular.
Any words following the terms including, include, in particular, for example or any similar expression shall be interpreted as illustrative and shall not limit the sense of the words preceding those terms.
Any obligation on a party not to do something includes an obligation not to allow that thing to be done.
A reference to these terms of use or to any other terms or document is a reference to these terms of use or such other terms or document, in each case as varied from time to time.

1. Agreement

These Terms are specific to the Anytime add-on. They are separate to the OVO Core Terms and Conditions (Core Terms: ovoenergy.com/terms) and any specific terms which may apply to the tariff you’re on.
2. What is Charge Anytime?
2.1 Charge Anytime is an add-on for OVO energy Customers with a compatible EV or charger. With Charge Anytime you pay a lower rate when Smart Charging your EV whilst the rest of the energy you use is charged at your tariff’s usual rate.
2.2 Our partner Kaluza provides the Kaluza Flex Platform, the intelligent software platform that powers the Charge Anytime add-on that you access by downloading the Charge Anytime App (the “App”) or your charger manufacturer’s smart charging app. Kaluza will gather data from your EV or charger via the Kaluza Flex Platform, and report your EV charging consumption data to OVO Energy so that we can credit your account correctly. Kaluza will also use the Kaluza Flex Platform to smart charge your EV so that it can be charged at times when the grid is likely to be greenest. The App is provided by Kaluza, so you will need to agree to Kaluza’s End User Licence Agreement (“EULA”) when you download the App.
2.3 Provided you meet (and continue to meet) the Eligibility Criteria (see section 6), you can sign up to Charge Anytime as follows:
If you have a compatible EV or charger you can sign up to Charge Anytime for free by downloading the Charge Anytime App (available from Google and Apple stores), registering your details and creating an App Account and completing the sign up journey; or
If you have a new fully electric Volvo you can sign up for Charge Anytime via your OVO account by completing the sign-up journey, or by downloading the Volvo Cars app, connecting your vehicle within the app and following the instructions in the Charge Anytime banner. Please refer to section 6 for more information on eligibility.
3. How it works
3.1 Charge Anytime works as follows:
Your home energy rate will stay the same, but the energy consumed by your home EV charger will be charged at the then current Charge Anytime Rate when Smart Charging. Rather than being charged at a lower rate for your Smart Charging, you’ll receive a credit to your bill (Charge Anytime Credit) – see section 5.3.
You’ll be charged at your standard tariff rate for energy used to charge your EV while in Boost Charging mode.
You’ll also be able to see insights about your EV charging and the savings you’re making with the Charge Anytime add-on in the “Your EV” section of your OVO energy account (either via a web browser or the OVO App).
3.2 Charging insights are only currently available if you connect to Charge Anytime via a smart charger, and will be available for EVs in due course. We’ll let you know when this happens.
4. Flexibility Services
4.1 In order to be able to charge your vehicle in accordance with the needs of the grid and enable lower cost charging, we'll sometimes participate in Flexibility Services and grid balancing events with Market Operators and Network Operators. This includes sharing charging pattern data from your EV with them as well as your Meter Point Administration Number (MPAN). Flexibility Services include, but are not limited to, the Demand Flexibility Service and other Balancing Services, Constraint Management Services, the Balancing Mechanism, Capacity Markets and other Flexibility Market trials or pilots. During Flexibility Services, we’ll still control your charging to deliver the required quantity of energy within the ready-by-time set by you.
4.2 By signing up to Charge Anytime and agreeing to these Terms you:
authorise us to enter Flexibility Service contracts with your EV and share relevant data with the relevant Market and Network Operators, including but not limited to your half-hourly consumption data, home address and Meter Point Administration Number (MPAN) where necessary;
give us the exclusive right to control your EV for the purposes of providing Flexibility Service Contracts (including but not limited to the Demand Flexibility Service, Constraint Management Services and Balancing Mechanism & Capacity Markets) as and when required by such contracts while you remain on Charge Anytime;
agree not to enter your household, your EV or any other low carbon technology you own into a third party’s scheme that enters you into a Flexibility Service (including but not limited to the Demand Flexibility Service, Distribution Constraint Management Services and Balancing Mechanism & Capacity Markets) while you remain on Charge Anytime. If we reasonably believe you have joined another third party’s scheme, we have the right to remove you from Charge Anytime.
4.3 By authorising us to provide Flexibility Services for your EV, charging and subsequent optimisation may result in shorter or more frequent charging cycles. While this service aligns with industry practices for such services, frequent charging may affect the lifespan of your EV's battery. We cannot accept liability for battery wear arising from use of the Flexibility Service.
5. Charge Anytime Credit
5.1 All electricity you use will initially be charged at the normal unit rate you pay for your OVO energy tariff – and these rates will be reflected in your live balance and on your bill, along with your normal standing charges.
5.2 In the first working week of each month, you’ll receive a credit based on how much of your total electricity use in the previous month went into charging your EV (as calculated by the Kaluza Flex Platform). This will be your Charge Anytime Credit.
5.3 The Charge Anytime Credit provided will effectively mean that each month your total balance will be equal to what you would have owed if your EV Smart Charging consumption had been charged at the Charge Anytime Rate.
5.4 All other energy use will be as per the rates on your standard OVO energy tariff, namely:
All home energy use will be charged at your standard OVO energy tariff rates for electricity and gas;
Standing charges (or "fixed charges") associated with your tariff will remain the same; and
Boost Charging will be charged at your standard OVO energy tariff electricity rate.
5.5 The amount of credit you’ll receive each month will vary depending on how much you charge your EV that month, how much you Smart Charge, and how much you Boost Charge. For an example of how your Charge Anytime Credit will be calculated, please see our FAQs.
5.6 Only electricity that has been used from the grid for Smart Charging will be considered in the Charge Anytime Credit calculation. For customers who have a solar PV installed in their home, OVO can only currently offer Charge Anytime Credit where the charger is a solar-compatible Indra, Hypervolt or Andersen charger (displayed as ‘solar-compatible’ on this list). Your charger may also require a house current clamp installation. All other local solar energy that goes into EV charging will be excluded from the Charge Anytime Credit calculation.
5.7 If you're a Direct Debit customer, your Direct Debit will not be affected by the Charge Anytime Credit applied to your account with the Charge Anytime add-on. If you have any Charge Anytime Credit left when you leave OVO, they will be offset against your final bill.
6. Eligibility
6.1 To be eligible for the Anytime add-on you must meet the following criteria (Eligibility Criteria):
You must be an existing OVO energy pay monthly customer – you can be on any OVO tariff (and either supplied with both fuels or electricity only);
You must have a compatible EV or EV Charger with a working internet connection. View list of compatible chargers and EVs at ovoenergy.com/electric-cars/charge-anytime-cars-and-chargers. It is your responsibility to ensure your EV charger has the most up to date firmware installed, otherwise your charger may not be compatible;
You must have a smart meter that can communicate half-hourly data to OVO – currently the main types of smart meters that work with Charge Anytime are SMETS2 meters by any manufacturer, and SMETS1 meters manufactured by Secure;
You have to opt in to sharing half-hourly smart meter data with OVO. If you aren’t currently opted in to sharing half-hourly data you agree that we can automatically update your preferences if you select the Charge Anytime add-on;
You have to comply and continue to comply with these Terms and the Core Terms and any other OVO terms which apply to you and Kaluza’s End User Licence Agreement;
The data you provide must be accurate (see section 8 for details).
7. Data sharing – what data we collect and how we use it
7.1 By signing up for the Charge Anytime add-on you agree to:
Be opted in to half-hourly data sharing from your smart meter.
7.2 You can change your data sharing preferences at any time but if you do so you’ll no longer be able to benefit from Charge Anytime, as we’ll no longer have the data we need to be able to provide the service to you.
7.3 We take looking after your data very seriously and will only ever use your data as set out in these Terms, the EULA and in accordance with our privacy policy. More information can be found in OVO Energy’s privacy policy (ovoenergy.com/privacy-policy) and Kaluza’s privacy policy (kaluza.com/flex-app-privacy-notice-uk).
8. Accuracy of data
8.1 Charge Anytime Credit will be added to your account based on the data that we receive from your home EV charger or compatible EV. If you’re accessing Charge Anytime via your compatible EV, this data will be modelled on data directly from your EV. If you’re connecting through your EV charger, the data will come to us from the charger manufacturer. This may result in some variations in the accuracy of the data and as a result, the accuracy and amount of your Charge Anytime Credit may also vary.
8.2 OVO takes no responsibility for the accuracy of the data received from your EV charger or compatible EV and therefore the accuracy of the Charge Anytime Credit paid using that data.
8.3 We may carry out checks on charging data we receive from time to time, and if we deem that your device is sending inaccurate data and is therefore not eligible for Charge Anytime, OVO reserves the right to remove the Charge Anytime add-on from your account. Please consult with your charger manufacturer or compatible EV manufacturer if you’re concerned about the accuracy of data recorded.
8.4 You’re responsible for making all arrangements necessary to ensure your EV charger or compatible EV is connected to the internet and to your OVO energy account via the App. You’ll also be responsible for downloading any updates to the App as required.
8.5 If your EV charger or compatible EV goes offline at any point for any reason, or if you’re disconnected from the Kaluza Flex Platform for any reason, we won't record Smart Charging energy consumption during this time. This means that you won’t receive Charge Anytime Credit for any charging done whilst your charger is offline or not sending EV charging data to us.
9. Changes to Charge Anytime
9.1 We reserve the right to make changes to Charge Anytime and these Terms at any time including without limitation amending the product, changing the Charge Anytime Credit or Charge Anytime Rate.
9.2 Where any changes we make put you at a disadvantage we’ll give you reasonable notice so that if you do not wish to continue using the Charge Anytime add-on, you can remove the Charge Anytime add-on by following the process outlined in section 10.
10. If you no longer want Charge Anytime
10.1 You’re free to remove the Charge Anytime add on from your account at any time. You can remove Charge Anytime any of the following ways:
If you're accessing Charge Anytime via your EV App or Charger’s App, go to your OVO energy app and click ‘Cancel my upgrade’ in the Upgrades section of your OVO energy account. Or if you're using a web browser, visit the ‘Plan’ section of your OVO energy account, and select ‘Cancel add-on’ within the Charge Anytime tile.
If you’re accessing Charge Anytime via the Charge Anytime app, delete your App Account within the Charge Anytime App by going to the App settings.
10.2 When your Charge Anytime add-on is cancelled, we’ll no longer receive your EV charging consumption data. Any Charge Anytime Credit accrued to the point of cancellation will be paid to you in the first week of the following month.
10.3 Once you remove Charge Anytime, your EV charging data will no longer be shared with OVO. You’ll no longer be able to access the “Your EV” page in your OVO energy account. Note it may take up to 7 days to fully disconnect your EV or charger from Charge Anytime, during which time data may still be collected from your device and the charging of your device may still be controlled.
10.4 If you're accessing Charge Anytime via the Charge Anytime app, please note that if you delete or discontinue use of the App but do not delete your App Account, we'll retain the capability to control your Connected Energy Device(s), and to perform those functions set out in clause 3.3 of the EULA. We'll retain this capability unless and until you terminate the connection between your Connected Energy Device and us by following the procedure set out above.
10.5 You can add Charge Anytime to your account again starting from the next month after you’ve cancelled.
11. Fair Usage Policy
11.1 You agree to comply at all times with the Charge Anytime Terms and agree that you’ll principally home charge your EV at the address registered on your OVO energy account. The maximum monthly Charge Anytime Credit you can receive from smart charging is £100 per month per account. Any smart charging consumption that exceeds the maximum Charge Anytime Credit will be charged at your tariff’s usual rate. For an example of what this Charge Anytime Credit equates to in monthly consumption please see our FAQs. The amount of monthly consumption this equates to may vary based on the current Charge Anytime rate and your tariff’s usual rate.
11.2 If OVO reasonably suspects you’re not acting in accordance with these Terms we reserve the right to remove Charge Anytime, having attempted to contact you first.
12. Suspension and termination
12.1 You agree to use the Charge Anytime add-on in accordance with these Terms and the EULA. If we have reason to believe that you’re in breach of these Terms or the EULA, or that you’re using the Charge Anytime add-on in a fraudulent manner – for example by setting up your EV charger in a way which means that the Charge Anytime Rate applies to energy consumption which isn’t related to the Smart Charging of your EV, or excessive overuse or misuse of the Charge Anytime add-on, we may immediately do any of the following:
Provide you with a warning;
Suspend the Charge Anytime add-on or remove it from your account;
Issue legal proceedings against you for reimbursement of all costs resulting from your breach and/or fraudulent use (including, but not limited to, reasonable legal and administrative costs);
Take further legal action against you; and/or
Disclose such information to law enforcement authorities as we feel is reasonably necessary.
13. Liability
13.1 We’ll not be liable to you for any failure to credit your account for reasons outside our reasonable control, including if we’re unable to gather adequate information from your EV charger, you do not leave your EV charger connected to the internet or the Kaluza Flex Platform, we cannot obtain half-hourly data reads from your Smart Meter, or you otherwise fail to comply with these Terms.
13.2 Save as set out in 13.3, our maximum liability to you under these Terms if you suffer any loss or damage (including to any EV or EV Charger) as a direct result of something we’ve done, will be no more than £10,000 per event or series of events if they’re connected.
13.3 Nothing in these Terms will limit or exclude our liability to you for death or personal injury as a result of our negligence, fraud or fraudulent misrepresentation, or any other matter in respect of which it would be unlawful for us to exclude or limit liability.

15. General
15.1 Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect. Even if we delay in enforcing these Terms against you, we can still enforce them later.
15.2 These Terms are governed by the laws of England and Wales if your property is in England or Wales, and the laws of Scotland if your property is in Scotland. If there is any dispute between us, it will be dealt with by the courts of England and Wales if your property is in England or Wales, and by the courts of Scotland if your property is in Scotland.
16. Definitions
Certain terms have a particular meaning when they are used in this document.
Balancing Mechanism: means the service procured by the National Electricity System Operator to manage supply and demand on the transmission network. For more detail, see Elexon’s definition here: elexon.co.uk/glossary/balancing-mechanism
Balancing Services: services procured by the National Electricity System Operator to balance demand and supply and to ensure the security and quality of electricity supply across Britain's transmission system.
Boost Charging: any charging that takes place in Boost mode (also referred to as Override, Urgent Charge or Max Charge), i.e. the EV charger is forced to charge at full power. Boost charging can also result from a lack of charging schedule in the app used to control when your vehicle will be ready by;
Capacity Markets: the service procured by the Government through yearly auctions to maintain sufficient generation capacity to meet peak national demand.
Charge Anytime Credit: the credit paid to your OVO energy account in the first week of each month, to adjust your bill such that your Smart Charging costs are effectively charged at the Charge Anytime Rate.
Charge Anytime Rate: the effective kWh rate offered to Charge Anytime customers for Smart Charging. For details of our current rates please see ovoenergy.com/electric-cars/charge-anytime
Charger App: means the app relating to your EV Charger
Constraint Management Services: services procured by Distribution System Operators to manage constraints on the distribution network or procured by the National Electricity System Operator to manage constraints on the transmission network.
Demand Flexibility Service: the service procured by the Electricity System Operator to manage supply and demand on the transmission system.
Distribution System Operators: the collective operators of Britain’s local electricity distribution network.
Electricity System Operator: the operator of Britain’s electricity transmission system.
EV: electric vehicle.
EV App: means your vehicle manufacturer’s application, for example the Volvo Cars app
Flexibility Services: refers to procured demand flexibility services and trials, including but not limited to, the Demand Flexibility Service, Constraint Management Services, the Balancing Mechanism, and Capacity Markets.
Kaluza: a company registered in England and Wales with company number 12218299, whose registered office is at 140–142 Kensington Church Street, London, W8 4BN and whose VAT number is 100119879. More about Kaluza at kaluza.com
Market Operator: means a third-party who operates the market for Flexibility Services on behalf of the Network Operator.
Network Operator: means either the relevant Distribution System Operator or the Electricity System Operator.
Smart Charging: any EV charging that takes place under control by the Kaluza Flex Platform, i.e. without the user selecting Boost mode for a scheduled charging session. Smart charging would typically involve the car being charged flexibly in accordance with the needs of the grid or local microgeneration, whilst delivering the required quantity of energy at the ready-by-time set by the user.
