Who we are
The OVO Community site is owned and operated by OVO Energy Limited (referred to as “OVO”, “we” or “our”), a company registered in England and Wales (company no. 06890795) whose registered address is 1 Rivergate Temple Quay Bristol, BS1 6ED.
2. By using the Community you accept these terms
2.1 These Terms of Use set out important information about your rights, obligations and the restrictions that apply to you when you access and use the Community. These Terms of Use apply in addition to our general terms and conditions (which can be found here: www.ovoenergy.com/terms) and our Privacy Policy (which can be found here: www.ovoenergy.com/privacy-policy), which also apply to your use of the Community
2.2 By accessing and using the Community, you acknowledge that you have read, understood and agreed to these Terms of Use and agree to comply with them, so please read them carefully.
2.3 If you do not agree with any part of these Terms of Use, you should not use the Community.
2.4 We recommend that you print a copy of these terms for future reference,
3. We may make changes to these Terms or the Community
We may update and amend these Terms of Use from time to time. Any changes will be posted on the Community and it is your responsibility to check for updates.
We may also update or change the features and functionality of the Community from time to time.
4. What age do you need to be to use the Community
To use the Community, you must be 18 years or older or 16 years or older if you live in Scotland.
5. How you can report content or make a complaint
If you see any content on the Community which you believe breaches these Terms of Service you can report this to [email protected] or by clicking on the three dots at the bottom right of any user generated content or comment and selecting the ‘Mod Alert’ option. Please tell us the reason you are flagging the content/comment. If you have clicked on ‘Mod Alert’ press the green ‘Mod Alert’ button to submit. One of our moderators will review the content and let you know the outcome and any action taken. You can also email [email protected] to raise any complaint about the Community.
6. How you may use the Community
6.1 The Community is a place where members can share knowledge and experiences about OVO, green energy and greener living, get information and help other members find an answer. By agreeing to these Terms of Use, you agree that you will only use the Community to post, send and receive messages and material that are appropriate and related to the purpose of the Community and that you will not misuse the Community. You also agree that any Content you post is accurate (where it states facts) and genuinely held (where it states opinions).
6.2 These Terms of Use apply to any material (including text, images, audio-visual content and other data) you upload, post, share or make available on or via the Community or generate on the Community (your “Content”). They also apply to any contact you make with other users on the Community, links to the Community, and any other ways you use the Community.
7. What is prohibited on the Community
7.1 You will not use the Community to upload, post, transmit, display, copy, distribute, promote, make available, continue to make available, knowingly receive or otherwise communicate to the public or any person using the Community any content which:
a) is abusive, hateful, bullying, intimidating or humiliating, libellous, defamatory, pornographic or obscene;
b) encourages, promotes or provides instructions for self-harm, eating disorders or suicide;
c) promotes or incites violence, terrorism, illegal acts;
d) promotes or incites hatred on the grounds of race (including colour, nationality, ethnic or national origin), ethnicity, cultural identity, religious belief, physical or mental disability, sex, gender identity, gender reassignment or characteristics of gender reassignment or sexual orientation;
e) depicts, encourages, promotes or provides instructions for an act of serious violence or injury or a challenge or stunt highly likely to result in serious injury;
f) encourages a person to ingest, inject, inhale or any other way self-administer a physically harmful substance or a substance in such a quantity as to be physically harmful;
g) with the purpose of harming or attempting to harm children in any way;
h) depicts real or realistic violence against or serious injury to a person (whether real or not), an animal (whether real or not), or a fictional creature;
i) includes video content that has been or would be likely to be given an R18 certificate by the British Board of Film Classification (BBFC) or which is not suitable for BBFC classification;
j) violates, plagiarizes, misappropriates or infringes the rights of third parties including, without limitation, copyright, trademark rights, rights of privacy or publicity, confidential information or any other right;
k) violates, breaches or is contrary to any law, rule, regulation, court order or is otherwise illegal or unlawful or fraudulent in OVO’s reasonable opinion;
l) contains unsolicited or unauthorized advertising, promotional messages, spam or any other form of solicitation;
m) contains any virus, Trojan horse, spyware, adware, malware, bot, time bomb, worm, or other harmful or malicious component, which or might overburden, impair or disrupt the Community or servers or networks forming part of, or connected to, the Community, or which does or might restrict or inhibit any other user's use and enjoyment of the Community;
n) is detrimental to the quality or the intended spirit of the Community, or that is completely off-topic; or
o) is otherwise objectionable in our reasonable opinion.
7.2 You must not use the Community in any way that involves any of the following:
a) terrorism;
b) child sexual exploitation or abuse (including grooming or child sexual abuse material);
c) hate offences;
d) harassment, stalking, making threats or abuse;
e) controlling or coercive behaviour;
f) intimate image abuse;
g) pornography;
h) sexual exploitation of adults;
i) human trafficking;
j) unlawful immigration;
k) fraud or financial offences;
l) proceeds of crime offences;
m) drugs or psychoactive substance offences;
n) firearms, knives or other weapons offences;
o) encouraging or assisting suicide;
p) foreign interference offences; or
q) animal cruelty.
7.3 When using the Community, you must not:
a) use the Community for anything other than your own personal, non-commercial use;
b) deliberately impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;
c) stalk, exploit, threaten, abuse or otherwise harass another user, or any OVO employee;
d) use or attempt to use another person’s Community account or password;
e) collect or attempt to collect personal data, or any other kind of information about other users, including without limitation, through spidering or any form of scraping;
f) employ scraping or similar techniques to aggregate, repurpose, republish or otherwise make use of any content including for the purposes of development, training, fine-tuning or validating AI systems or models; or
g) employ any techniques or make use of any services, automated or otherwise, designed to misrepresent the popularity of your posts on the Community, or to misrepresent your activity on the Community.
8 How we monitor the Community
8.1 We may review any of your Content on the Community to determine if it complies with these Terms of Use. This includes any contact you make with other users on the Community. We may also use software or other automated tools to review content on the site for breaches of these Terms of Use.
8.2 We can remove Content temporarily or permanently at any time without giving you notice. We can restrict, suspend or terminate your access to the Community or any part of it without giving you notice. We will do this if we suspect, believe or are investigating whether there has been a breach of these Terms of Use.
8.3 We will determine whether any Content or your use of the Community breaches these Terms of Use.
8.4 If you breach these Terms of Use we can edit or delete any of your Content, to terminate your Community account and to take such other action as we think is necessary. This includes reporting any breaches to the relevant authorities or taking court action.
9. You must not introduce viruses
You must not misuse the Community by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with the Community or any part of it. You must not attempt to gain unauthorised access to the Community, the server on which it is stored or any server, computer or database connected to the Community or any other equipment or network connected with the Community. You must not interfere with, damage or disrupt any software used in the provision of the Community or any equipment or network or software owned or used by any third party on which the Community relies in any way. You must not attack the Community via a denial-of-service attack or a distributed denial-of-service attack.
If you breach this term you will commit a criminal offence under the Computer Misuse Act 1990. We will report any breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Community will cease immediately.
10. Your responsibility for your Content and the rights you give us
10.1 Any Content that you post, upload, provide or submit to the Community is generated, owned and controlled solely by you, and not by OVO. You acknowledge and agree that your Content remains your sole responsibility.
10.2 By uploading or posting your Content on or via the Community, you acknowledge that your Content will be exposed to the public.
10.3 We will consider any Content you upload or post to the Community to be non-confidential and not protected by any trademark, patent or copyright.
10.4 By using the Community, you grant us (and our affiliated companies and service providers) a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable and transferable right and licence to use, adapt, reproduce, translate, create derivative works, copy, distribute, transmit, publicly display, edit, translate and reformat your Content. No compensation will be paid for the use of your Content, and we have no obligation to post or use any Content you provide.
11. Your indemnity to us
You will indemnify us against any loss, damage or expense incurred by us (or our affiliates) caused by:
a) your misuse of the Community or the information accessible through the Community; and
b) any third-party claim of infringement of copyright or other intellectual property rights arising from the hosting of your Content on the Community or the actual use of your Content by other users of the Community or by us in accordance with these Terms of Use.
This means that you will be responsible for any loss or damage we suffer as a result of these things.
12. OVO’s content on the Community
12.1 We are the owner or licensee of all intellectual property rights in this Community and all material or content supplied or made available by us on the Community will remain at all times the property of OVO or OVO’s licensors. We reserve all of our rights in our content on the Community.
12.2 The names, images and logos identifying OVO and its subsidiaries, partners or third parties and their products and services contained in the Community are proprietary marks and may not be reproduced or otherwise used by you without our permission. You have no licence or right (implied or otherwise) to use any trademark, patent, design right or copyright owned by us or any third party.
13. We do not guarantee availability, content or that the Community is free from viruses
13.1 OVO makes available the Community to you on an “as is” and “as available” basis; we do not guarantee the availability of the Community. OVO also makes no representations or guarantees that the Community will be free from errors or omissions or that it will be available uninterrupted and in a fully operating condition.
13.2 We do not guarantee that our site will be secure or free from bugs or viruses. It is your responsibility to maintain adequate anti-virus software on your personal computer at all times whilst accessing the Community.
14. Our responsibility for loss or damage suffered by you
14.1 We do not accept any liability for:
a) any damage or loss you suffer as a result of using the Community, including any damage to your computer, any software or any loss of data;
b) you being unable to access the Community or any content if caused by or related to any event or circumstance beyond our reasonable control, or to ensure we comply with applicable laws or regulations; or
c) any claims brought against you by a third party except as stated in these Terms of Use.
14.2 We do not exclude or limit our liability for death or personal injury resulting from our negligence or fraud, or for any form of liability which cannot be limited or excluded by law.
14.3 If we disable your Content or suspend or terminate your account in breach of these Terms of Use you can make a claim for breach of contract.
15. Do not rely on information on the Community
15.1 The content on the OVO Forum is provided by us and by other users for general information only. The information and materials provided by other users have not been verified or approved by us. We cannot guarantee the accuracy, integrity or quality of any content made available by other users of the Community. It is not intended to amount to advice on which you should rely. You understand that you must evaluate the content, including its accuracy.
15.2 Where the Community contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.
15.3 We recommend that you take professional or specialist advice before taking action or deciding not to take action based on any content on the OVO Forum. You are responsible for any use you make of any content, including any reliance on the content.
16. How to request your account be deleted
Your OVO Community account and any Content you post may not be automatically deleted even after you stop using the Community. If you want us to delete your account email us at [email protected] from the email address associated with your account and request that your Community account be deleted.
17. We may suspend or withdraw the Community
We do not guarantee that the Community, or any content on it, will always be available or be uninterrupted. We may stop providing all or part of the Community at any time without giving you notice.
18. Which laws apply
18.1 These Terms of Use will be exclusively governed by and construed in accordance with the laws of England and Wales.
18.2 Any dispute arising in connection with these Terms of Use will be subject to the exclusive jurisdiction of the courts of England and Wales except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
