Post Trial V2G Terms & Conditions

1. Our Agreement

1.1 These Vehicle-to-Grid Post Trial terms and conditions (the Terms and Conditions)  form the agreement between you and us:

(a) you are the person who is agreeing to continue receiving Export Credits;

(b) we, us or our is OVO Energy Limited. Our address is 1 Rivergate, Temple Quay, Bristol, United Kingdom, BS1 6ED.

1.2  These Terms and Conditions will only apply to you if you:

  1. have previously been part of our Vehicle-to-Grid Trial; and 
  2. continue to export energy from your Charger to the grid after your original Trial Period ended in exchange for  Export Credits from us.

1.3 These Terms and Conditions are specific to the provision to you of  Export Credits. They supersede the OVO Vehicle-to-Grid Trial Terms & Conditions (which applied for the trial period up to 2 years after your V2G Installation). They are also separate to the OVO Supply terms and conditions which govern the supply of energy to you.

1.4 Capitalised terms shall have the meaning given to them at clause 17 unless otherwise defined elsewhere.

1.5  As well as OVO another company is mentioned in these Terms and Conditions – Kaluza. Kaluza is OVO’s intelligent energy software company. Kaluza’s Software is responsible for the V2G webapp which controls the electricity your vehicle imports and exports and your Charger’s other Smart Features (the Kaluza Software). 1.6 ChargedEV is our installation partner and was commissioned to complete the installation of your Chargers and provide on site maintenance support during the Vehicle-to-Grid trial. See Clause 4 for more information.

1.7 Indra is the manufacturer of your Charger.

2. Introduction

2.1 Vehicle-to-Grid (V2G) export credits (Export Credits) are amounts credited to your OVO energy bill which you receive in exchange for the number of kWhs of electricity exported by your Charger to the grid.

2.2 You will have already been receiving Export Credits as part of the Vehicle-to-Grid trial. Although the trial has now ended, you can  continue to use your Charger to export electricity to the grid in exchange for Export Credits in accordance with these terms.

2.3  It is intended that your Export Credits will stay the same until January 2023, and the V2G webapp will continue to work to control your Charger at least until then too. However, we do not guarantee that this will be the case and we do reserve the right to amend or withdraw Export Credits at any time in accordance with clause 12.

2.4  By accepting these Terms and Conditions you agree to continue to receive Export Credits in return for allowing Kaluza to control your Charger and export electricity from your Charger to the grid.

3. Eligibility

3.1 You will only be eligible for Export Credits if you have previously participated in the Vehicle-to-Grid trial and continue to meet the following eligibility criteria (Eligibility Criteria):

  1. you are on any of our single rate fixed energy plans or our Simpler Energy plan. Customers opting for a multi-rate OVO plan (like Economy 7) will not be eligible for Export Credits;
  2. you pay for your Supply by monthly direct debit;
  3. you have an OVO SMETS1 Smart Meter installed and have opted into half hourly data sharing from your OVO Smart Meter (and will remain opted in for as long as you wish to receive Export Credits)
  4. you have On-site Microgeneration, its maximum power output is equal to or below 4kW;
  5. you have On-site Microgeneration, you agree to continue to waive your deemed export payment with your current FiT licensee as you are paid on your actual exports by us. 
  6. you allow us control of charging and discharging your electric vehicle’s battery; 
  7. the Nissan LEAF you use with the Charger has a battery capacity of 30kWh or greater (if you do not comply with this, it may have implications for your Nissan warranty, see clause 17.5 for more information);
  8. you agree to use the Kaluza web-app available as part of the Smart Features to control the settings and your vehicle’s charging schedule; 

3.2 Please note that Export Credits are provided at OVO’s absolute discretion and may be removed any time, even if you meet the Eligibility Criteria. 

4. Using your V2G Charger

4.1 Ownership of the Charger passes to you at the end of your Vehicle-to-Grid trial in accordance with the Vehicle-to-Grid Trial Terms [link].

4.2 If you experience any problems with the Charger after the end of the trial you can contact us by emailing [email protected] quoting the serial number, the date of Installation and a brief description of the issue and our support team will get in touch with you to help diagnose the problem. 

4.3 If something goes wrong with your Charger and it cannot be resolved remotely, we can help you by putting you in touch with our EV charging partners, ChargedEV and the manufacturer, Indra. Please note that any repairs or replacements will be at your own cost.

4.4 You need to ensure that you keep your Charger connected to your broadband at all times. If your broadband connection is lost at any point the Charger will lose its Smart Features and you will not be able to export electricity to the grid. As a result, you will not receive Export Credits for the period that the connection is lost. If this occurs, you will still be able to charge your electric vehicle.

5. Software

5.1 The Kaluza Software controls the Charger by sending and receiving instructions about when to charge and discharge your vehicle battery. It receives information about when you plug in and unplug your vehicle, the state of charge of your battery and how long it takes to charge. It includes a web-app where you can set your preferences including your charging schedule. Using this data, the Kaluza Software makes decisions about charging and discharging which are sent to the Charger.

5.2 From time to time, we may update the software and/or firmware running on your Charger. These updates may be to: 

  1.  ensure your Charger functions correctly; 

(b) fix any issues that may arise; improve the way your Charger works; 

(c) add/remove data points that are reported by the device; or

(d) add/remove further functionality; or for other reasons.

5.3 If you opt out of Kaluza controlling your Charger you will no longer be able to export electricity to the grid or receive Export Credits.

5.4 Kaluza and its affiliates own (and will continue to own) all intellectual property rights in and associated with the Kaluza Software.

6. Export Credits

6.1 Export Credits will be credited to your OVO energy bill and be shown  as a separate line on your bill, with the title “V2G export credit”. 

6.2 The value of the Export Credits you receive will depend on the amount of electricity which is exported from your property to the grid. For more information about pricing for the Export Credits, please refer to the pricing table.

6.3 If you are a customer with On-site Microgeneration at home then your rate for your Export Credits will be different to customers without On-site Microgeneration. For more information please see the pricing table.

6.4 If at any point, your OVO Smart Meter stops communicating with us and we cannot receive half hourly readings from your meter, we may stop your Charger from exporting from your vehicle battery and your Export Credits will stop until the issue is rectified. We will give you 30 days notice before we stop your Export Credits.

6.5 If at any point you opt-out of half hourly data sharing from your OVO Smart Meter, we will no longer be able to provide you with the Export Credits. 

7. Fair usage

7.1 For each calendar month, the number of kWhs you export to the grid from your vehicle must be less than or equal to the number of kWhs you import from the grid through your Charger.

7.2 If you are not complying with clause 7.1, we’ll let you know and we’ll give you 30 days to ensure that the number of kWh exported is less than or equal to those imported. If you do not rectify this within 30 days, we may disable your exports and stop paying you Export Credits.

8. Switching away from OVO Energy

8.1 If you switch your supply to a different supplier, we'll no longer be able to supply you with electricity or sell your exported electricity back to the grid. You will therefore lose your Export Credits and may lose some Smart Features of your Charger. We will only pay you Export Credits up until whichever is earliest, your exports are disabled or the date of your Supply switch.

8.2 If you wish to keep exporting energy from your Charger after you switch, you will need to notify your new supplier that you would like to switch your Export MPAN as well as your import supply.  Alternatively, you can let us know and we’ll disable exports from your charger and decommission your Export MPAN with OVO.

9. Moving out of your Property

9.1 If you move out of the Property where your Charger is installed, we'll no longer be able to supply you with electricity or control your Charger. You will therefore lose your Export Credits and Smart Features. If you are required to remove the Charger as a term of the sale this will be at your responsibility and cost. 

  1. If you no longer want to export your electricity or receive Export Credits

10.1 You may request to stop exporting your electricity and stop receiving Export Credits at any time, by giving us a minimum of 5 Working Days’ notice.Please write to us at [email protected]

11. Charger removal

11.1 If you elect to have your Charger removed at the end of the Vehicle-to -Grid trial this will be done free of charge provided you contact [email protected] to make this request no later than 2 months after your trial end date. 

11.2 If you decide you want to remove the Charger after this period, as the owner of the unit you will be responsible for organising and paying for this removal via a third party who will quote you for the work. You may want to contact our  experienced partners ChargedEV or find your own EV specialist. 

11.3 If we remove the Charger, we will remove the unit from the wall and any cabling put in place as part of the Charger installation.

11.4 If, having been given permission by you, we removed an existing chargepoint as part of your Charger installation, we will not replace this charger or do any work to re-attach your old charger to the wall.

11.5 You acknowledge that removal of the Charger may cause some incidental damage and this will be your responsibility. You may need to redecorate, repair or restore certain areas once the removal is completed. This is not included in the removal and you will be responsible for this. But we’ll fix any unnecessary damage that is not incidental and is directly caused by our negligence.

12. Termination and Changes

12.1 We reserve the right to withdraw  Export Credits at any time by giving you 30 days' notice. We may also make changes to Export Credits or these Terms and Conditions at any time. We’ll update them on our website if we do. Please check this page regularly to review updated terms. The date these terms and conditions were last updated is at the top of this page. If we make changes to these terms and conditions that are disadvantageous to you, we'll let you know about the changes at an appropriate time (leaving you reasonable time to avoid the changes by cancelling your subscription should you wish to do so). 

12.2 We may terminate this agreement with immediate effect if you breach any of your obligations under this agreement or fail to satisfy the Eligibility Criteria. In this case, you will no longer receive the Export Credits from the date of your breach or failure to satisfy the Eligibility Criteria. 

12.3 We may also terminate your participation in Export Credits at any time on notice to you, for any reason.

13.  Our Liability

13.1 We won’t be responsible for:

(a) any costs, loss or damage you suffer as a result of events outside our reasonable control. Matters outside our reasonable control include: severe weather conditions; epidemics; civil disorder; terrorist activity; hacking, tampering or other unauthorised access or use of the Kaluza Software or Charger; war; acts or omissions of electricity network operators, and government action;

(b) any costs, loss or damage you suffer as a result of not using the the Charger in line with our instructions and this agreement; 

(c) any costs, loss or damage you suffer as a result of your broadband internet connection being insufficient in quality, capacity or speed to support your use of the Charger and/or your use of the Charger results in you exceeding the permitted data limit on your broadband; or

(d) for any loss or damage you suffer (including any consequential loss) caused by us, our Engineer or agents to the extent such loss or damage results from any breach by you of this agreement;

(e) any loss or damage you may suffer (including any consequential loss) as a result of the provision of services relating to your Charger (including its repair or removal) by Charged EV, Indra or any other third party;

13.2 We use the Internet to receive triggers and to send notifications to your Charger – we’ll do our best to keep our infrastructure running but there may be instances which prevent or delay notification delivery or performance of any service. We won’t be responsible for any delays, delivery failures, or any other loss or damage resulting from the transfer of data over communications networks and facilities, including the internet, and you acknowledges that the Kaluza software and ability to control your Charger may be subject to limitations, delays and other problems inherent in the use of such communications facilities.

13.3 We (and our partners) have taken reasonable care in the development of the V2G webapp and the Kaluza Software. However, Ovo shall not be liable for loss or damage which you or a third party may incur in the event that the V2G webapp and / or the Kaluza Software fails due to a fault with your network access or with the device on which the software is installed, including if you have failed to apply operating system updates (unless you suffer damage to your device or content on the device due to our failure to exercise reasonable care and skill). If the failure of the V2G webapp and / or the Kaluza Software is as a result of a technical issue with the software itself and you have notified us of the issue, Ovo will endeavour to remedy the issue as soon as we reasonably can. Ovo does not exclude liability for losses arising from our negligence or breach of duty, but we will not be liable for losses that could not reasonably have been foreseen at the time you accepted these terms. 

13.4 Ovo will not be liable for damage or loss which would have been avoided by following our advice to apply an update offered to you free of charge or which was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.

13.5 We aren’t liable, whether caused by breach of contract, negligence, breach of statutory duty or otherwise, for any (a) loss or damage that we couldn’t reasonably have expected would result from breach of this agreement at the time you entered into it, or (b) for any loss of business or profit; or (c) for any indirect or consequential losses which you or anyone else suffers.

13.6 Nothing in this agreement will affect our liability to you for death or personal injury as a result of our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

13.7 Our maximum aggregate liability in connection with these Terms and Conditions(whether for breach of contract, negligence, breach of statutory duty or otherwise) in connection is limited to £10,000.

13.8 It is your responsibility to ensure that your Nissan LEAF complies with the requirements set out in clauses 3.2(c) of this agreement. If you sign up to the Trial and your Nissan LEAF does not comply with the requirements in clauses 3.2(g), this may invalidate your warranty. Notwithstanding anything in this agreement, we will not be liable for any loss incurred by you as a result of not complying with clauses 3.1(g).

13.9  If you make a claim on your vehicle’s warranty your warranty provider may ask us to share data on your Charger’s charging behaviour with your warranty provider to support your claim. Your vehicle warranty provider will be able to tell you whether they require this information from us.

14.  Use of your Personal Data

14.1  By receiving Export Credits you agree that we may:

(a) access any data or information generated, collected, processed or stored by the Charger; and

  1. access any data or information generated, collected, process or stored by Kaluza, and

(c) collect other information about you and your electricity usage as part of providing the Charger.

14.2 We use the information we access and/or collect to:

  1.  provide you with Export Credits and optimise the provision of our V2G services;

  2. provide services to the grid;

  3. improve functionality of the Kaluza algorithm;

  4. diagnose problems that affect V2Gcustomers; 

  5. share aggregated (non-personally identifiable) data about how V2G helps the grid with the media;

    14.3 We take the protection of your data very seriously. Any data processed as part of the V2G Export Credits proposition will only be used in accordance with Kaluza’s privacy policy and OVO’s privacy policy.

    14.4  You may opt out of sharing your data at any time by emailing [email protected]. However by opting out you will no longer be eligible to export your electricity or receive the Export Credits as we will no longer be able to receive the information we need to enable this to happen.

15. Complaints Procedure 

15.1 You can submit a complaint in person, in writing or over the phone by:

(a) calling us on 0330 303 5063;

(b) using our online web form at https://www.ovoenergy.com/help/feedback or 

(c) writing to us or visit us at OVO Electricity Limited, 1 Rivergate, Temple Quay, Bristol, BS1 6ED.

15.2 We'll aim to respond to your complaint the same day we receive it. If you’re not happy with our response, you can ask for your complaint to be escalated to our internal complaints team, who will be in touch within five Working Days.

16.  Other Conditions

16.1 We can transfer any of our rights or obligations under this agreement without your permission. However, you must not transfer your rights or obligations under this agreement to anyone without our permission.

16.2 If we need to give you a notice for any reason in connection with this agreement, we will use the postal address and/or email address you have given us most recently.

16.3 If we post a notice to you, it will be assumed to have been delivered two Working Days after it was posted.

16.4 If we deliver a notice to you by hand or by email, it will be assumed to have been delivered immediately when it was delivered or sent to the most recent address we have for you (as applicable). 

16.5 This agreement, and any documents explicitly referred to in it, is the entire agreement between you and us in relation to the Trial.

16.6 Nothing in this agreement affects our legal rights or powers. Nothing in this agreement affects any of your statutory rights that can’t be excluded by law.

16.7 If any part of this agreement is void or unenforceable, the rest of the agreement will be unaffected.

16.8 This agreement is governed by the laws of England and Wales if your Property is in England or Wales, and in Scotland if your Property is in Scotland. If there is any dispute between us, it will be dealt with by the courts of England and Wales if your Property is in England or Wales, and by the courts of Scotland if your Property is in Scotland. 

17. Definitions

17.1 In these Terms and Conditions the following definitions apply:

ChargedEV means Charged Electric Vehicles Limited, a company incorporated under the laws of England and Wales (registered number 12702971) and having its registered office at Unit 1 Silver House, Adelphi Way, Chesterfield, S43 3LJ.

Charger means the OVO Energy Vehicle-to-Grid 6kW electric vehicle home charge point (including any ancillary equipment components that may be provided by us);

Engineer means one of our (or a subcontractor’s) engineers who is qualified to carry out the removal of the ChargerOur Engineers will carry an identity card;

MPAN means Meter Point Administration Number and is a 21-digit reference used in Great Britain to uniquely identify electricity supply points such as a domestic residence. You can find your MPAN on your electricity supply bill, or from your electricity supplier;

On-site Microgeneration means small scale electricity generation equipment installed at the Property (including, but not limited to solar photovoltaic cells and wind turbines) provided it is included within Ofgem’s Microgeneration Certification Scheme;

OVO Smart Meter means an electricity pay monthly meter that is able to provide OVO Electricity with half hourly meter readings through wifi or GSM;

Property means the property or premises at which the Charger will be installed and has an Electricity Supply; 

Smart Features means the internet connected features of the Charger and the associated web-app for viewing live & historic charging data, scheduling charge times and getting insights on your vehicle charging;

Supply (or similar expressions) means the sale by OVO Electricity to you of electricity via an electricity distribution network;

Working Day means any day other than a Saturday, a Sunday or a bank holiday in England, Scotland or Wales. All other references to a day refer to a calendar day.
