Anytime add-on for OVO Drive: Terms & Conditions

1. Agreement

These Anytime add-on terms and conditions (the Terms and Conditions) form the agreement between you and us:

(a) “you” are the person who has signed up to the Anytime add-on;

(b) “OVO”, “we”, “us” or “our” is OVO Energy Limited. Our address is 1 Rivergate, Temple Quay, Bristol, United Kingdom, BS1 6ED and we are registered under company number 06890795 with VAT number 100119879.

These Terms and Conditions are specific to the Anytime add-on.  They are  separate to the OVO Core Terms and Conditions which govern the supply of energy to you and the OVO Drive tariff terms and conditions.

Definitions

Certain terms have a particular meaning when they are used in this document. We have listed those terms in clause 13, and they are highlighted in bold when they are used.

Our Partners

As well as OVO, another company is mentioned in these Terms and Conditions – Kaluza. Kaluza is the intelligent software platform that powers the Anytime add-on. Kaluza will help us to provide you with the add-on by gathering data from your home EV charger via the Kaluza Flex Platform and reporting your EV charging consumption data to OVO so that we can credit your account correctly. When using the Kaluza Flex Platform, you will need to agree to Kaluza’s End User Licence Agreement, which is available here. 2. What is Anytime?

 2.1  Anytime is an add-on for OVO members with EVs who are on the OVO Drive energy plan. The add-on provides users with a lower rate when Smart Charging their EV whilst keeping  their household energy consumption rates the same. 

2.2 With the Anytime add-on, your home energy rate will stay the same, but the energy consumed by your home EV charger will be charged at an effective rate of 10p/kWh when Smart Charging. You will be charged at your normal OVO Drive tariff rate for energy consumed by your  EV while Boost Charging.  

2.3 Members with the Anytime add-on will also be able to see insights about their EV charging and the savings they’re making with the Anytime add-on in the “Your EV” section of their OVO account when accessing via a web browser. 

3. How does Anytime add-on work?

3.1 With the Anytime add-on, all electricity you consume will initially be charged at the normal unit rate you pay on your OVO Drive plan and these rates will be reflected in your live balance and on your bill, along with your normal standing charges. On the first working day of each month, you will receive a credit based on how much of your total electricity usage in the previous month went into charging your electric vehicle (as calculated by the Kaluza Flex Platform). This will be your Anytime Charging Credit. The Anytime Charging Credit provided will effectively mean that each month your total balance will be equal to what you would have owed if your EV Smart Charging consumption had been charged at the Anytime EV Charging Rate (currently 10p/kWh inclusive of VAT). 

3.2  All other energy consumption will be as per the rates on your existing OVO Drive plan, namely:

  • all home energy consumption will be charged at your normal OVO Drive rates for electricity and gas;

  • standing charges (or ‘fixed charges’) associated with your tariff will remain the same; and 

  • Boost Charging will be charged at your normal OVO Drive electricity rate. 

    3.2 The amount of credit you will receive each month will vary depending on how much you charge your EV from the grid during that month, how much you Smart Charge, and how much you Boost Charge.

    3.3 An example of how your Anytime Charging Credit will be calculated and applied is set out below:

Example

A customer uses 500 kWh of electricity in August, of which 200 kWh went to Smart Charging their EV, and 300 kWh went into their home. Their Anytime EV Charging Rate is 10p/kWh for Smart Charging and their normal OVO Drive rate is 30p/kWh.

The customer used Boost Charge twice that month, totalling 50kWh of Boost Charging out of the 200kWh. 

On 1st of September, the customer’s account will show the following:

Electricity used: £150 (500 kWh at 30p/kWh)

Anytime credit: £30

Net customer balance: £120 

The £140 electricity used charges the customer for all of their electricity (500kWh) at the standard OVO Drive rate. The Anytime Charging Credit then works out that out of the 200kWh, 150kWh was Smart Charging and should be charged at the cheaper Anytime EV Charging Rate of 10p/kWh. 50kWh was Boost Charging and is charged at the standard OVO Drive rate. The discount is calculated as follows:

Anytime Charging Credit (£) = (OVO Drive rate – Anytime EV Charging Rate) x energy used by EV Smart Charging 

Anytime Charging Credit (£) = (0.30 - 0.10) x 150

Anytime Charging Credit (£) = £30

3.4 Only electricity that has been consumed from the grid for Smart Charging will be considered in the Anytime Charging Credit calculation. For customers with solar PV installed at their home, local solar energy that goes into EV charging will be excluded from the Anytime Charging Credit calculation.

3.5 If you are a Direct Debit customer, your Direct Debit will not be affected by the Anytime Charging Credits applied to your account with the Anytime add-on. If you have any Anytime Charging Credits left when you leave OVO Energy, this will be offset against your final OVO bill.

4. How to get the Anytime add-on, and eligibility

4.1 To get the Anytime add-on, you must first be a live customer on the OVO Drive tariff.

4.2 Once you're on OVO Drive, you'll be able to see the Anytime banner on the 'Offers' page of your OVO account. You can access this using a web browser or the OVO app.

4.3 The Anytime banner will take you through a journey to link your home EV charger to your OVO account, via the Kaluza Flex Platform. 

4.4  To be eligible for the Anytime add-on you must:

  • be an existing OVO Drive customer; 

  • use an eligible home EV charger with a working internet connection or use a compatible electric vehicle with a working internet connection. The list of chargers that are eligible is:

  • have a smart meter that can communicate half-hourly data with OVO. Currently the main types of smart meters that are eligible are SMETS2 meters by any manufacturer, and SMETS1 meters manufactured by Secure; and

  • opt in to sharing half-hourly smart meter data with OVO. If you aren’t currently opted in to sharing half-hourly data you agree that we can automatically update your preferences if you select the Anytime add-on.  Please note that members with solar PV installed at their home are eligible provided their EV charger is equipped with an external current clamp, installed at the electricity meter point to monitor the proportion of charging originating from the solar panels.

    4.5 Your charger must report energy data that is accurate to within ±10%. OVO may carry out checks on charging data we receive from time to time, and customers whose devices we believe to be inaccurate may have the add-on removed from their account. 

5. Data sharing 

5.1 By signing up for the Anytime add-on you agree:

(a) to allow OVO to share your data (your email address, electricity rates, electricity MPAN and OVO ID) with Kaluza to notify them that you are an Anytime customer and to allow them to provide smart charging services; 

(b) to allow Kaluza to share details relating to your EV including make and model, efficiency and battery capacity, as well as EV charging consumption data with OVO, via the Kaluza Flex Platform; and

(c) to be opted in to half-hourly data sharing from your smart meter. 

5.2 We take the protection of your data very seriously. Any data processed will only be used in accordance with Kaluza’s privacy policy and OVO’s privacy policy.

6. Data Accuracy and exclusions 

6.1 Anytime Charging Credits will be added to your account based on the data that we receive from your home EV charger, the accuracy of which may vary. As a result, the accuracy of your Anytime Charging Credits may also vary. OVO takes no responsibility for the accuracy of the data received from your EV charger and therefore the accuracy of the Anytime Charging Credits paid using that data. However, if we deem that your device is sending inaccurate data and is therefore not eligible for Anytime, OVO reserves the right to remove the Anytime add-on from your account (see clause 4.5). Please consult with your charger manufacturer if you are concerned about the accuracy of data recorded by your charger. 

6.2 You are responsible for making all arrangements necessary to ensure your EV charger is connected to the internet and also to your OVO account via the Kaluza Flex Platform. If your EV charger goes offline at any point for any reason, or your EV charger is disconnected from the Kaluza Flex Platform for any reason, we will not record Smart Charging energy consumption during this time. You will therefore not receive Anytime Charging Credits for any charging done whilst your charger is offline or otherwise not sending EV charging data to us. 

7. Changes to the Anytime product 

We reserve the right to reduce or withdraw the Anytime add-on at any time with 30 days' notice to you. This includes changing the Anytime EV Charging Rate. If you do not wish to continue using the Anytime add-on following this notice, you can remove the Anytime add-on by following the process outlined in clause 9. 

8. Removing the Anytime add-on 

8.1 You’re free to remove the Anytime add-on at any time. If you’re using a web browser, this can be done by visiting the ‘Plan’ section of your OVO account, and selecting ‘Cancel add-on’ within the Anytime tile.
If you’re using the OVO app, you can remove it by clicking ‘Cancel my upgrade’ in the Upgrades section of your OVO account.

8.2 As soon as you remove the Anytime add-on, OVO will no longer receive your EV charging consumption data. Any Anytime Charging Credits accrued to the point of cancellation will be paid to you on the 1st of the following month.

8.3 Once you remove Anytime, your EV charging data will no longer be shared with OVO. You will no longer be able to access the “Your EV” page in your OVO Account. 

8.4 You can add Anytime to your account again starting from the next month after you’ve cancelled. 

9. Liability

9.1 If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breaching these Terms and Conditions or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted these Terms and Conditions, both we and you knew it might happen. 

9.2  We will not be liable to you for any failure to credit your account for reasons outside our reasonable control, including if we are unable to gather adequate information from your EV charger, you do not leave your EV charger  connected to the internet or the Kaluza Flex Platform, we cannot obtain half-hourly data reads from your Smart Meter, or you otherwise fail to comply with these Terms and Conditions.

9.3 Nothing in these Terms and Conditions will limit or exclude our liability to you for death or personal injury as a result of our negligence, fraud or fraudulent misrepresentation, or any other matter in respect of which it would be unlawful for us to exclude or limit liability. 

9.4 Save as set out in clause 10.3, our maximum liability to you under these Terms and Conditions if you suffer any loss or damage as a direct result of something we’ve done, will be no more than £10,000 per event or series of events if they’re connected.

10. Suspension and Termination

10.1 You agree to use the Anytime add-on in accordance with these Terms and Conditions. If we determine (acting reasonably) that you are in breach of these Terms and Conditions or that you are using the Anytime add-on in a fraudulent manner, for example by setting up your EV charger in a way which means that the Anytime EV Charging Rate applies to energy consumption which isn’t related to the Smart Charging of your EV, we may immediately do any of the following:

  1.  provide you with a warning;
  2. suspend the Anytime add-on or remove it from your account;
  3. issue legal proceedings against you for reimbursement of all costs resulting from your breach and/or fraudulent use (including, but not limited to, reasonable legal and administrative costs);
  4. take further legal action against you; and/or
  5. disclose such information to law enforcement authorities as we feel is reasonably necessary.

11. General 

11.1 We reserve the right to change these Terms and Conditions. Unless the reason for the change is due to a change in law or for security reasons – in which case we may need to change these Terms and Conditions on shorter notice – we will provide you with at least ten (10) days’ advance notice of any changes. If you do not wish to continue using the Anytime add-on following changes to these Terms and Conditions, you can cancel your Anytime add-on by following the process outlined in Clause 8.

11.2 You must not transfer your rights or obligations under these Terms and Conditions to anyone without our permission. We can transfer any of our rights or obligations under these Terms and Conditions without your permission. If we transfer our rights pursuant to this clause 12.2 and your rights are materially affected, we will notify you and you may cancel your Anytime add-on by following the process outlined in clause 9. 

11.3 These Terms and Conditions are governed by the laws of England and Wales if your property is in England or Wales, and the laws of Scotland if your property is in Scotland. If there is any dispute between us, it will be dealt with by the courts of England and Wales if your property is in England or Wales, and by the courts of Scotland if your property is in Scotland.

12. Definitions

Anytime Charging Credits: the credits paid to your OVO account on the first of each month to adjust your bill such that your Smart Charging costs are effectively charged at the Anytime EV Charging Rate

Anytime EV Charging Rate: the effective rate offered to Anytime customers for Smart Charging. 

Boost Charging: any charging that takes place in Boost mode (also referred to as Override or Max Charge), i.e. the EV charger is forced to charge at full power.

EV: electric vehicle. 

Smart Charging: any EV charging that takes place under control by the Kaluza Flex Platform, i.e without the user selecting Boost mode for the charging session. Smart charging would typically involve the car being charged flexibly in accordance with the needs of the grid / local microgeneration, whilst delivering the required quantity of energy by the ready-by-time set by the user. 

13. Other Important Information

13.1 Each of the clauses of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.

13.2 Even if we delay in enforcing these Terms and Conditions against you, we can still enforce them later. If we do not immediately insist that you do anything you are required to do under these Terms and Conditions, or if we delay in taking steps against you for breaching them, that will not mean that you do not have to do those things and will not prevent us taking steps against you at a later date.
